Service Description

WP Order Alerts is a service offered by WP Enhanced that provides real-time notifications of new orders from your WooCommerce store to your mobile device through a mobile application. The Service connects to your WooCommerce store via a Helper Plugin and utilizes third-party services, including Stripe for payment processing and OneSignal for notification delivery.

Subscriptions and Payments

• The Service is available under various subscription tiers, including free and paid options. Details of these tiers, including features and pricing, are available on the Website.
• Payments for subscriptions are processed through Stripe. By subscribing to a paid tier, you agree to Stripe's terms and conditions.
• We reserve the right to modify the subscription fees and to introduce new charges at any time, with at least 30 days' notice provided to you.

Account Registration

You must register for an account to access certain features of the Service. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, complete, and updated.

Mobile Applications

• The Service's mobile application is initially available on the Google Play Store, with an iOS version planned.
• You acknowledge that the availability of the mobile application is dependent on the third-party from which you received the application license, such as the Android app store ("App Store"). You agree to comply with all applicable third-party terms of agreement when using the mobile application.

Beta Program

• We may offer you the opportunity to participate in a Beta Program to test new features or improvements. Participation is voluntary and subject to separate terms that will be provided to you.
• Beta Program participants are not entitled to discounts or special offers unless explicitly stated otherwise.

User Conduct

You are responsible for your use of the Service and for any use of the Service made using your account. You agree not to access or use the Service in any manner that is illegal or that infringes on the rights of others.

Data Privacy and Security

• User Data: We are committed to protecting the privacy and security of our users. As part of our operations, we collect minimal user data, which includes but is not limited to, your Name, Email Address, and an Encrypted Password. It's important to note that we do not store detailed WooCommerce order details. However, for operational purposes, we log order IDs. This practice is crucial for facilitating order tracking, customer service, and enhancing your user experience.
• Third-Party Services: In our effort to offer enhanced functionalities, we partner with third-party service providers. For instance, we utilize OneSignal for sending notifications. Users are identified within OneSignal by device ID and WPOA Account ID. As our valued user, you are encouraged to review OneSignal's privacy policy to understand their data handling practices. Please be aware that we do not control the privacy practices of our third-party partners.

Marketing Communications

By creating an account with WP Order Alerts, you agree to receive marketing emails and other communications from us related to the Service. You may opt out of receiving these communications at any time by updating your preferences on your profile page or following the unsubscribe link in the email communications.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Service Dependencies and Notification Delivery

Our services, including notification delivery, depend on the operational functionality of third-party services such as OneSignal. Additionally, the successful receipt of notifications is contingent upon you having access to either internet or cellular service. We endeavor to ensure timely and accurate delivery of notifications. However, we shall not be held responsible for missed notifications due to reasons beyond our control, including but not limited to, third-party service failure or connectivity issues.

Limitation of Liability

General Disclaimer: We strive to ensure that our services, including the delivery of notifications via third-party services like OneSignal, are executed in a timely and accurate manner. Despite our efforts, certain factors outside our control may affect the performance and reliability of these notifications. These factors include but are not limited to operational issues with third-party services, and users' access to internet or cellular services.

Limitations on Our Responsibility: We shall not be liable for any damages, losses, or inconveniences suffered by users as a result of missed notifications or any disruptions in the service caused by:

1. Third-Party Service Failures: Failures, outages, or disruptions in the services provided by third parties, including OneSignal. While we select our third-party service providers carefully, we cannot guarantee their uninterrupted operation.

2. Connectivity Issues: Users’ lack of access to necessary internet or cellular services required for the receipt of notifications. It is the user's responsibility to ensure they are in an area with adequate connectivity to receive notifications.

3. Operational Limitations: Any limitations inherent to the technology used for delivering notifications. This includes limitations related to device compatibility, operating system restrictions, or user settings that may prevent the successful delivery of notifications.

Scope of Liability: In no event will we, or our directors, employees, or agents, be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services, any content delivered to you through our services, or your inability to receive notifications, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been informed of the possibility of such damage.

User Acknowledgment: By using our services, you acknowledge and agree to this limitation of liability and assume full responsibility for any risks associated with your use of our services, including the receipt of notifications through third-party services.
